General Terms & Conditions of sale

Our General Terms and Conditions of Sale conform to the provisions of Decree No. 94-490 of 15th June 1994 pursuant to Article 31 of Law No. 92-645 of 13th July 1992 establishing the conditions for conducting business activities relating to the organisation and sale of travel and holidays. In order to comply with legal provisions, we are reproducing Articles 95 to 103 of that Decree.

Article R.211-6 -

Prior to the conclusion of the contract and on the basis of a written document bearing its company name, address and an indication of its current administrative authorisation, the vendor must inform the consumer of the prices, dates and other aspects of the services provided in the trip or holiday such as:
1. Destination, methods, characteristics and categories of transport used;
2. Type of accommodation, location, standard of comfort and principal characteristics, type approval and tourist classification corresponding to the usages and regulations of the host country;
3. Meals provided;
4. Description of the itinerary in the case of a tour;
5. Administrative and health formalities to be carried out, particularly in relation to crossing borders as well as timing;
6. Visits, excursions and other services included in the package or available at an additional cost;
7. Minimum and/or maximum size of the group for the holiday or trip and, if the trip or holiday depends on a minimum number of participants, the final date for informing the consumer in the event of the trip or holiday being cancelled; this date may not be less than twenty-one days prior to departure;
8. The amount or percentage of the price to be paid by way of deposit on conclusion of the contract and the dates for paying the balance;
9. The price review procedures as specified in the contract pursuant to article R.211-10;
10. Cancellation conditions of a contractual nature;
11. The cancellation conditions specified in articles R.211-11, R.211-12 and R.211-13;
12. Details of the risks covered and amount of cover taken out under the insurance policy covering the consequences of the travel agent’s professional liability and the public liability of non-profit-makassociations and organisations and local tourist organisations;
13. Information on taking out an optional insurance policy covering the consequences of certain circumstances of cancellation or an assistance policy covering certain specific risks, in particular the cost of repatriation in the event of an accident or illness;

Article R.211-7 -

Prior information given to the consumer shall be binding on the vendor unless within it the vendor expressly reserves the right to change certain elements. In such case the vendor must clearly indicatehow that change takes place and which elements it affects. In any event, changes made to such prior information must be given to the consumer in writing before the contract is concluded.

Article R.211-8 -

The contract concluded between the vendor and the purchaser must be in writing, produced in duplicate, one copy of which is to be given to the purchaser, and signed by both parties. It must contain the following clauses:
1. The name and address of the vendor, its guarantor and insurance company as well as the name and address of the organiser;
2. The destination or destinations of the journey and, in the event of a split holiday, the various periods and their dates;
3. The types, characteristics and categories of transport used, departure and return dates, times and venues;
4. Type of accommodation, location, standard of comfort and principal characteristics, tourist classification in accordance with the usages and regulations of the host country;
5. Number of meals provided;
6. Itinerary in the case of a tour;
7. Visits, excursions and other services included in the total price of the trip or holiday;
8. The total price of the invoiced services and an indication of any review of this invoicing in accordance with the provisions of article R.211-10;
9. An indication, if appropriate, of any fees or charges relating to certain services such as landing, boarding or disembarkation charges in ports and airports, and tourist taxes if these are not included in the price of the service(s) supplied;
10. The dates and methods of paying the price; in any event, the last payment made by the purchaser may not be less than 30% of the price of the trip or holiday and must be paid on delivery of the documents enabling the trip or holiday to be undertaken;
11. Any particular conditions requested by the purchaser and accepted by the vendor;
12. The procedures by which the purchaser may make a claim on the vendor for non-execution or poor execution of the contract, any such to be sent as soon as possible, by registered letter with acknowledgementof receipt, to the vendor and which may be reported in writing to the organiser of the trip and the service provider concerned;
13. The last date for informing the purchaser of the cancellation of the trip or holiday by the vendor where the trip or holiday is dependent on a minimum number of participants, in accordance with the provisions of paragraph 7 of Article 211-6;
14. Cancellation conditions of a contractual nature;
15. The cancellation conditions specified in Articles R.211-11, R.211-12 and R.211-13;
16. Details about the risks covered and the amount of cover of the insurance policy covering the consequences of the vendor’s professional liability;
17. Information about the insurance policy taken out by the purchaser covering the consequences of certain circumstances of cancellation (policy number and name of insurance company) as well as the assistancepolicy covering certain particular risks, in particular the cost of repatriation in the event of an accident or sickness; in such case, the vendor must give the purchaser a document specifying at least the risks covered and those excluded;
18. The final date for informing the vendor in the event of the purchaser transferring the contract;
19. A written undertaking to provide the purchaser with the following information at least ten days before the scheduled departure date:
a) The name, address and telephone number of the vendor’s local representative or failing this, the names, addresses and telephone numbers of local bodies that may be able to assist consumers, or failing this a telephone number through which the vendor may be contacted without delay;
b) For minors travelling and staying abroad, an address and telephone number via which the minor and/or the person in charge of them at the location of their stay may be contacted.
20. The clause covering penalty-free cancellation and refund of sums paid by the purchaser in the event of failure to provide information as required in clause 14 of article R.211-6.

Article R.211-9 -

The purchaser may transfer his contract to a transferee who fulfils the same conditions as himself in respect of taking the trip or holiday as long as the contract has not yet come into force. Unless there is a stipulation more favourable to the transferor, the latter shall inform the vendor of their decision by registered letter with acknowledgement of receipt at least seven days prior to the start of travel. In the
case of a cruise, that time limit is increased to two weeks. Under no circumstances shall such transfer be subject to the vendor’s prior authorisation.

Article R.211-10 -

If the contract includes the express possibility of a price review, within the limits provided for in article L.211-13, it shall state the exact method of calculation of upward and downward price variations, and in particular the amount of transport expenses and related taxes, the currency or currencies which may have an impact on the price of the trip or holiday, the portion of the price to which the variation applies and the exchange rate of the currency or currencies used as a reference when establishing the price appearing in the contract.

Article R.211-11 -

If it becomes necessary for the vendor to alter any of the essential aspects of the contract, such as a significant price increase, and it fails to abide by the obligation of information specified inarticle R.211-6 clause 14, the purchaser may, without prejudice to claiming compensation for any loss suffered, and after having been informed by the vendor of this matter by registered letter with acknowledgement of receipt: - Either cancel their contract and secure an immediate refund of any monies paid, without penalty; - Or accept the change or replacement trip offered by the vendor; an amendment to the contract specifying those changes shallthen be signed by the parties; any price reduction shall be deducted from any monies still payable by the purchaser and if the payment already made by the latter exceeds the price of the amended service, any over-payment must be refunded to him before his date of departure.

Article R.211-12 -

In the case provided for by article L.211-15, if, before the departure of the purchaser, the vendor cancels the trip or holiday, they must inform the purchaser by registered letter with proof of receipt; without prejudice to claiming reparation for any loss suffered, the purchaser shall receive an immediate refund of any monies paid from the vendor without penalty; in such case, the purchaser shall receive compensation of at least the penalty he would have incurred if he had made the cancellation on that date. The provisions of this article shall not impede the conclusion of an amicable agreement whereby the purchaser accepts a replacement trip or holiday offered by the vendor.

Article R.211-13 -

If, after the purchaser’s departure, the vendor is unable to provide a preponderant part of the services provided in the contract, representing a not insignificant percentage of the price paid by thepurchaser, the vendor must immediately take the following action without prejudice to any claim for reparation of any loss suffered:
- Either offer services to replace the initial services, bearing any additional cost and, if the services accepted by the purchaser are of inferior quality, the vendor must refund the price difference as soon as he returns;
- Or offer other services to replace those initially planned, bearing any additional costs; if the services accepted by the purchaser are of a lower standard, the vendor must reimburse the difference in price to the purchase as soon as they return home; or, if he cannot offer any replacement service or if they are rejected by the purchaser on valid grounds, provide the purchaser, at no additional cost, travel tickets so that he can return to thepoint of departure or to another venue accepted by both parties under conditions deemed to be equivalent.
The provisions of the articles shall apply in the event of failure to abide by the obligation set forth in article R.211-6 clause 14.

Our general terms and conditions of sale comply with the
provisions of article R.211-12 of the French Tourism Code. In
order to respect legal provisions, we have printed the articles
R.211-3 to R.211-11 of the aforementioned Code.
Art. R.211-3 - Subject to the exclusions provided for in the third
and fourth paragraphs of article L.211-7, any offer and any sale
of a holiday gives rise to the handover of appropriate documents
which comply with the rules defined by this section.
Art. R.211-3-1 – The exchange of pre-contractual information
or the issuing of contractual terms and conditions is carried
out in writing. They may be sent by e-mail under the terms and
conditions of validity and the procedure detailed in articles 1369-1
to 1369-11 of the civil code. The name or corporate name and the
address of the seller, as well as details of their registration are
given in the register, detailed at (a) of article L.141-3 or, where
applicable, the name, address and details of registration of the
federation or union are given in the second paragraph of article
R.211-2.
Art. R.211-4 - Before finalising the contract, the sales
organisation must inform the customer of prices, dates and other
details concerning services available during the holiday such as:
1. Type of accommodation, location, standard of comfort and
principal characteristics, type approval and tourist classification
corresponding to the usages and regulations of the host country;
2. Restaurant services offered;
3. Description of the itinerary in the case of a tour;
4. Administrative and health formalities to be carried out by
nationals or by citizens of another member state of the European
Union or a state which is party to the Agreement of The European
Economic Area, particularly in the event, of crossing borders as
well as meeting the deadlines for undertaking them;
5. Visits, excursions and other services included in the package or
available at an additional cost;
6. Any minimum and/or maximum size of the group for the holiday
or trip and, if the trip or holiday depends on a minimum number
of participants, the final date for informing the consumer in the
event of the trip or holiday being cancelled; this date may not be
less than twenty-one days prior to departure;
7. The amount or percentage of the price to be paid by way of
deposit on conclusion of the contract and the timetable for paying
the balance;
8. The price review procedures as specified in the contract
pursuant to article R.211-8;
9. Cancellation conditions of a contractual nature;
10. The cancellation conditions specified in articles R.211-9,
R.211-10 and R.211-11;
11. Information on taking out an optional insurance policy covering
the consequences of certain circumstances of cancellation or an
assistance policy covering certain specific risks, in particular the
cost of repatriation in the event of an accident or illness ;

When the contract is agreed via e-mail, articles 1369-1 to 1369-11
of the civil code apply. It must contain the following clauses:

insurance company as well as the name and address of the
organiser;
2. The destination or destinations of the journey and, in the event
of a split holiday, the various periods and their dates;
3. Type of accommodation, location, standard of comfort and
principal characteristics, tourist classification in accordance with
the usages and regulations of the host country;
4. Restaurant services offered;
5. Itinerary in the case of a tour;
6. Visits, excursions and other services included in the total price
of the travel or holiday;
7. The total price of the invoiced services and an indication of
any review of this invoicing in accordance with the provisions of
article R.211-8;
8. An indication, if appropriate, of any fees or charges relating to
certain services such as tourist taxes if these are not included in
the price of the service(s) supplied;
9. The timetable and method of paying the price; the last payment
made by the purchaser may not be less than 30% of the price
of the travel or holiday and must be paid on delivery of the
documents enabling the holiday to be undertaken;
10. Any particular conditions requested by the purchaser and
accepted by the vendor;
11. The procedures by which the purchaser may make a claim
on the vendor for non-performance or poor performance of the
contract, any such to be sent as soon as possible, by registered
letter with acknowledgement of receipt, to the vendor and which
may be reported in writing to the organiser of the service
provider concerned should it be required;
12. The last date for informing the purchaser of the cancellation
of the holiday by the vendor where the holiday is dependent on
a minimum number of participants, in accordance with the
provisions of paragraph. 7 of Article 211-4;
13. Cancellation conditions of a contractual nature;
14. The cancellation conditions specified in Articles R.211-9,
R.211-10 and R.211-11;
15. Details about the risks covered and the amount of cover of
the insurance policy covering the consequences of the vendor’s
professional liability;
16. Information about the insurance policy taken out by the
purchaser covering the consequences of certain circumstances
of cancellation (policy number and name of insurance
company) as well as the assistance policy covering certain
particular risks, in particular the cost of repatriation in the
event of an accident or sickness; in such case, the vendor must
give the purchaser a document specifying at least the risks
covered and those excluded;
17. The final date for informing the vendor in the event of the
purchaser transferring the contract;
18. An undertaking to provide the purchaser with the following
information at least ten days before the scheduled departure
date:
a) the name, address and telephone number of the seller’s
local representative or failing this, the names, addresses and
telephone numbers of local bodies that may be able to assist
consumers, or failing this a telephone number through which
the seller may be contacted without delay;
b) for minors staying abroad, an address and telephone
number via which the minor and/or the person in charge of
them at the location of their stay may be contacted ;
19. The clause covering penalty-free cancellation and refund
of sums paid by the purchaser in the event of failure to provide
information as required in clause 13 of article R.211-4;
20. The commitment to supply the purchaser, in the time
requested prior to the start of the stay, departure and arrival
times.
Art. R.211-7 - The purchaser may transfer his contract to
a transferee who fulfils the same conditions as himself in
respect of taking the holiday as long as the contract has
not yet come into force. Unless there is a stipulation more
favourable to the transferor, the latter must inform the vendor
of his decision by registered letter with acknowledgement of

The provisions of this article are applicable in the event of nonadherence
to the obligation set out in the paragraph 13 of article
R.211-4.
PARTICULAR TERMS AND CONDITIONS OF SALE
ARTICLE 1 - REGISTRATION / BOOKING / PAYMENT
1.1- Registration and booking terms and conditions
Every registration must be accompanied by a payment including:
• The administration charge for Pierre & Vacances, Pierre &
Vacances Holiday Villages, and Pierre & Vacances Premium:
- For bookings via the internet: €20 per booking for any stay of 7
nights or more, €10 per booking for any stay of 6 nights or less;
- For other bookings: €35 per booking for any stay of 7 nights or
more, €25 per booking for any stay of 6 nights or less;
The administration charge for Maeva:
- For bookings via the internet: €0.
- For other bookings: €30 per booking for any stay of 7 nights or
more, €20 per booking for any stay of 6 nights or less;
Important: you will not be asked for any administrative fees for
bookings made in Adagio City Aparthotels and Latitudes hotels.
• A deposit corresponding to:
- 25% of the overall price of your booking and any additional
services, whether included or not, in particular meals, children’s
clubs, sporting activities, etc.
- 100% of the value of insurance premiums if you want to take out
the insurance.
1.2- Premium facility
- From the date of payment of fees and advances up to the 31st
day (for a stay in a tourist residence) or the 15th day (for a stay in
a hotel or hotel apartment) inclusive preceding your stay, you will
benefit from a premium facility. If you exercise it, the deposit paid
will be refunded to you but the above mentioned administration
charge will be retained by PVCP. The total amount of insurance is
payable upon reservation and cannot be reimbursed.
- Your attention is drawn to the fact that business relating to the
organisation and sale of holidays for a specific date and/or period
is not subject to the seven-day «cooling-off» period which applies
to other forms of remote sales.
1.3- Payment of the balance
The full price of your booking plus any additional services is
payable:
- 30 days before the start of your holiday in a tourist residence,
- 14 days before the start of your holiday in a hotel or hotel
apartment,
- or in all cases immediately for any last minute reservations.
The full price must have been paid, before you are sent your travel
documents (including your rental contract or accommodation slip,
description of the location etc.) by PVCP.
If you have not settled the account within the specified timeframe
and you have not used your premium facility, PVCP reserves the
possibility to consider the sale as definitive from either the 30th
day or the 14th day before your stay depending on your reservation
and may apply the cancellation conditions drawn up for this
event and defined hereafter as a consequence. Your commitment
therefore become final on payment of the balance before the 30th
or 14th day of your stay or, in the event of non-payment of the
balance and no use of the premium facility on your behalf, from
the 30th or 14th day preceding your stay. PVCP’s commitment
becomes final before the 30th or 14th day preceding your stay,
from the sending of your reservation confirmation.
1.4- Methods of payment
• For all bookings up to 31 days before your holiday, you may pay
100% of the cost of your holiday by any method of payment: bank
card (*), cheque (**), or bank transfer (***)
• For all bookings between 30 and 15 days prior to your holiday,
you may:
- pay 100% of the cost of your holiday by bank card (*)
- or pay 25% of the cost of the holiday as a deposit by bank card (*)
and the balance within 5 days by cheque (**) or bank transfer (***).
• For all bookings between 14 and 8 days prior to your holiday,
you may:
- pay 100% of the cost of your holiday by bank card (*)
- or pay 50% of the cost of the holiday as a deposit by bank card (*)
and the balance within 5 days by cheque (**) or bank transfer (***).
• For all bookings made less than 7 days prior to the beginning
of the holiday, you must pay 100% of the cost of your holiday by
bank card only (*).
For the Hotel de l’Esterel and the Hotel du Pont-Royal in Provence
Payments may be made by bank card (*), cheque (**) or bank
transfer (***). For any reservation less than 15 days before the
start of the stay, payment is only possible by bank card.

Your travel documentation
Sent 30 (or 14) days before the start of your holiday on condition
of the settlement of the balance of your holiday, you will receive
travel documentation containing: all the practical information
required to help you get organised (itinerary, map, address) and
the rental contract for your accommodation and the services
booked.

vouchers, gift vouchers (subject to the terms and conditions to be
validated by the salesperson)

ARTICLE 2 – PRICES
2.1 – Price
Prices for services are established according to the economic data
in place when the prices were set. A change in the applicable
taxes can lead us to alter the prices of the above-mentioned
services.
2.2 - Accommodation
Our prices include all taxes and include the provision of the
accommodation, including charges (water, electricity, heating) but
excluding tourist tax, (payable on site), supplementary services,
optional insurance premiums and administration charges,
payable on booking where applicable. We would remind you that
accommodation provided for a specific number of occupants on
booking may not be occupied by a larger number of people. It
is reminded that young children are considered as occupying a
complete space. Some of our balconies, loggias, terraces and
gardens are not equipped with tables and chairs.
2.3 - Optional services
Our accommodation rates do not include optional extra services
on offer in the catalogue, on our website or on site.
2.4 – Right to sunshine (Atlantic and Normandy coast)
2.4.1 – Eligibility Conditions
Our accommodation prices include a right to sunshine offer, only
valid during the 2012 Summer Season from 31/03/12 to 11/11/12,
excluding the period from 6/07/12 to 3/09/12, through which you
can ask to change the site or dates of your holiday, as soon as the
following combined conditions are met:
1) The initial booking must have been made directly with PVCP:
on the Internet Site www.pierreetvacances.co.uk, directly with
the residences of PIERRE & VACANCES, PIERRE & VACANCES
HOLIDAY VILLAGES or PIERRE & VACANCES PREMIUM, or
through the booking centre on 0870 0267 144 or 0870 0267 145,
apart from those not reserved directly with PVCP , in particular,
Tour Operators,
2) the booking must concern a holiday taking place on a site of the
brand ”PIERRE & VACANCES”, “PIERRE & VACANCES HOLIDAY
VILLAGES”, or “PIERRE & VACANCES PREMIUM” as applicable,
located on the Atlantic or Normandy coast,
3) the holiday booked must be for a minimum duration of seven
consecutive nights,
4) the holiday booked must not take place during the months of
July and August (outside of the period from 6/07/12 to 3/09/12)
2.4.2 – Conditions of application
On condition of respecting the conditions covered in point 2.4.1
above, you can make a request for modification of the site or dates
of your holiday under the following conditions :
1) the internet site www.lachainemeteo.com must forecast a
minimum of 2 days of rain during your booked holiday,
2) Your modification request can only be made with the Booking
Centre on 0891 70 1000, or with the residence where your booking
was made,
3) If your request modification must be carried out between three
and five days before your booked holiday,
4) Your modification request must be express, limited to one
request per holiday booked
2.4.5 – Conditions of the new holiday
The new booking is possible only in the 2012 Summer Season
(from 31/03/12 to 11/11/12, excluding the period from 6/07/12 to
3/09/12), and for a duration of at least equal to that of the modified
holiday, availability permitting.
Modification of the destination is possible for all the seaside
resorts of the brand ”PIERRE & VACANCES”, “PIERRE &
VACANCES HOLIDAY VILLAGES”, or “PIERRE & VACANCES
PREMIUM” , including those located on the Mediterranean,
according to availability;
If the new holiday is more expensive than the modified holiday, you
will have to pay the difference; if the new holiday is less expensive,
you will be reimbursed with a credit note.
2.5 – Discounts and offers
The discounts and offeres mentioned in the brochure are only
applicable on the accommodation section; any other services are
excluded (restaurants, sport and leisure, etc).
These offers are subject to specific terms and conditions
communicated with the actual offer and can be withdrawn at
any time.
ARTICLE 3 - TOURIST TAX
Tourist tax, collected on behalf of the local authorities, is not
included in our prices. It is approximately €1 per person per day
and should be paid on site.
ARTICLE 4 - ALTERATION / CANCELLATION OF HOLIDAY BY
THE CUSTOMER
4.1 - Modification
4.1.1 - Accommodation
a) For the hotels and aparthotels
For any hotel stay of three nights or less, we will endeavour to
accept your requests to change the date, type of accommodation
or holiday venue as far as possible and subject to availability.
These alterations may be made at no additional cost. Any
request to reduce the length of your holiday will be deemed
by PVCP to be a partial cancellation and will be subject to the
cancellation terms referred to in 4.2 hereafter.
For any hotel stay of three nights or less, we will also
endeavour to accept your requests to change the date, type of
accommodation or holiday venue as far as possible and subject
to availability. If the value of your booking (excluding optional
services) after the alteration is lower than the value of the
booking before the alteration, we will retain €10 as a charge for
this alteration. Any request to reduce the length of your holiday
will be deemed by PVCP to be a partial cancellation and will be
subject to the cancellation terms referred to in 4.2 hereafter.
b) For tourist residences
• Change of type
We will endeavour to accept your requests to change the type
of apartment as far as possible and subject to availability. If
the value of your booking (excluding optional services) after
the alteration is lower than the value of the booking before the
alteration, we will retain €10 as a charge for this alteration.
• Change of holiday date or place
We will endeavour to accept your requests to change the date
or holiday venue as far as possible and subject to availability.
However, please note that this type of change causes variable
costs for PVCP depending on the date on which you make your
request.
Therefore for all changes of holiday date or place, we will apply
the following charges:
- if your request for modification is sent at least 30 days before
your arrival and if the amount of the modified booking is less
than the amount of the initial booking: 10 euros
- if your request to change is made between 30 and 15 days
prior to your arrival: 15% *
- if your request to change is made between 14 and 8 days prior
to your arrival: 30% *
- if your request to change is made between 7 and 4 days prior
to your arrival: 50% *
* of the total cost of the accommodation.
No request to change will be taken into account if it is received
by PVCP three days or less prior to your arrival.
NB:
- any request to extend the Length of your holiday will be
accepted by PVCP without any additional charge
- any request to reduce the length of your holiday will be
deemed by PVCP to be a partial cancellation and will be subject
to the cancellation terms referred to in 4.2 hereafter.
4.1.2 – Optional services
We will endeavour to accept your requests to change the
optional services as far as possible and subject to availability. If
your request for a modification is made before the 30th day (for
a holiday in a residence) or the 14th day (for a holiday in a hotel
or hotel apartment) before your holiday, we will not retain any
modification fees. If your request is made within 30 days (for a
holiday in a Residence) or 14 days (for a holiday in a hotel or
hotel apartment) before your holiday:
- if the value of your optional service after the alteration is lower
than the value of the optional service before the alteration, we
will retain •10 as a charge for this alteration.
- if the sum of your optional service after modification turns out
to be equal or superior to the sum of the optional service before
modification, we will not retain any modification fee.
4.2 – Cancellation (total or partial)
In the event of cancellation you must notify us either by post to
the following address PIERRE ET VACANCES CENTER PARCS,
service annulations BP291 75921 PARIS CEDEX 19, or by fax +33
(01) 58 21 50 97 for the attention of «service annulations», or by
e-mail to the following address: annulation.adv@fr.groupepvcp.
com. The date of cancellation is determined by the date of
receipt of notification.
4.2.1 - Accommodation
a) Holiday in a Residence
Whatever the date your booking is cancelled, we will retain
the administration charges, if applicable, initially paid and any
insurance premiums taken out.
From the 30th day prior to your holiday, we will retain the
following indemnities depending on your holiday package:
- if your request to change is made between 30 and 15 days
prior to your arrival: 25% *
- if your request to change is made between 14 and 8 days prior
to your arrival: 50% *
- if your cancellation request is made seven days or less before
your arrival: 100% *
* of the total cost of the accommodation.
b For holidays in a hotel or apparthotel
Whatever the date of the booking is cancelled, we will retain the
amount of any insurance premiums taken out.
For all holidays of less than 3 nights, we will retain an indemnity fee
equal to 1 night for all cancellations after 6 PM
Furthermore, for any stay greater than three nights, if you inform
us after the 14th day preceding your arrival and before 3 pm the
day before your arrival, we will retain the following compensation
depending on the terms of your holiday: 18 hours
4 to 6 nights, payment for one night*,
7 nights or more, payment for two nights*,
*the cost of the “night” corresponds to the total price of the holiday
booked divided by its number of nights.
Half-board or full board holiday:
The charges will be the same as above.
Holiday in the Hotel de L’Esterel or Hotel du Pont Royal during the
months of July and August 2012.
Whatever the date of the booking cancelled, we will retain the
amount of any insurance premiums taken out.
Furthermore, from 14 days prior to your arrival, we will retain the
following compensation:
- if your request to change is made between 14 and 8 days prior
to your arrival: 50%*
- if your cancellation request is made seven or less before your
arrival: 100%*
* of the total cost of the accommodation
4.2.2 – Optional services
For all cancellations of optional services invoiced (activities,
meals) before 30 days (for a holiday in a Residence) or 14 days (for
a holiday in a hotel or hotel apartment) before your holiday, we
will not retain any cancellation fees. For any additional services
invoiced (activities, meals, etc.) cancelled after the 30th day (for
a holiday in a residence e) or 14th day (for a holiday in a hotel or
hotel apartment) preceding your holiday, we will retain €10 per
cancelled service for cancellation costs.
Special case (1): For all cancellations of an ESF skiing lesson or our
‘Well-being’ formulas undertaken 4 days before the start date, we
will retain 100% of the sum for the service. .
Special case (2): the entrance ticket for Parc Disneyland® and Parc
Walt Disney Studios® is non-reimbursable.
4.3 - No-show at the holiday venue
If you do not turn up at your holiday venue, we will retain the
administration charge initially paid and the premiums for any
insurance policies taken out plus the following:
4.3.1 - Accommodation
a) Holiday in a Residence
• 100% of the total value of the holiday.
b) Holiday in a hotel
• Accommodation only:
1 to 3 nights, payment for one night*,
4 to 6 nights, payment for two nights*,
7 nights or more, payment for two nights*,
* the cost of the “night” corresponds to the total price of the holiday
booked divided by its number of nights.
• Half-board or full board holiday:
The charges will be the same as above.
Holiday in the Hotel de l’Esterel or Hotel du Pont Royal during
the months of July and August 2012: 100% of the total value of
the holiday.
4.3.2 – Optional services
You will not receive any refund for not using any booked and
invoiced services at your holiday venue. We advise you to take out
one of the insurance deals with Europ assistance (see Article 18 -
Insurance). The premium must be paid in full at the time of booking
and is not refundable in any circumstances.
ARTICLE 5 - NON-EXCHANGEABLE AND NON-REFUNDABLE
HOLIDAYS AND OFFERS
Certain holiday offers are marked “Non exchangeable and nonrefundable”.
For these stays, the following conditions replace the
conditions for cancellation and modification detailed in article 4.
5.1 The character of non-exchangeable, non-refundable and nonmodifiable
items
Given the preferential rates on offer from PVCP, acceptance
of booked Offers and/or Holidays is non-exchangeable, nonrefundable
and cannot be altered in any way. No requests for
alterations and/or cancellations can be taken into consideration.
Irrespective of the date on which a booking is cancelled, we
withhold the administration charge and a penalty payment equal
to 100% of the total cost of the accommodation. You will not be
refunded for the non-consumption of optional services booked and
already paid for.
NB/ “Non exchangeable and non-refundable” holidays are not
eligible for cancellation insurance, the sunshine guarantee..
5.2 No-show at holiday venue
If you do not present yourself at your holiday venue, we withhold
the initial administration charge plus a penalty payment equal to
100% of the total cost of the accommodation.

ARTICLE 6 - ARRIVAL AND DEPARTURE
- For «PIERRE & VACANCES» and «PIERRE & VACANCES HOLIDAY VILLAGES»:
PIERRE & VACANCES draws your attention to the fact that failing full payment
in spite of reminders to do so, you will not be given the keys to accommodation
if you present yourself at your holiday destination. Keys are issued from 5pm on
the day of your arrival provided the said payment has been made. These keys
must be handed in by 10 AM on the day of your departure (Saturday in most
cases). For short stays, keys are available from 2pm and must be returned before
12 noon on the day of departure. If you cannot arrive at the specified time due to
a major difficulty, it is essential that you inform the residence so that in certain
cases you can obtain the access codes. They will then make arrangements
directly with you so that you can obtain the keys to your accommodation when
you arrive.
- For “PIERRE & VACANCES PREMIUM»:
PIERRE & VACANCES PREMIUM draws your attention to the fact that failing
full payment in spite of reminders to do so, you will not be given the keys to
accommodation if you present yourself at your holiday destination.
For any stay of a week (seven nights) or more, key handover takes place from
5pm on the day of arrival (Saturday in most cases) subject to payment of the said
sum. Keys are to be returned before 10am on the day of departure. After this
time you will be charged for an extra night.
For short stays, keys are available from 2 PM subject to payment of the said
sum and must be returned before 12 noon on the day of departure. After this
time you will be charged for an extra night. If you cannot arrive at the specified
time due to a major difficulty, it is essential that you inform the residence so
that in certain cases you can obtain the access codes. They will then make
arrangements directly with you so that you can obtain the keys to your apartment
when you arrive.
- For «MAEVA»:
MAEVA draws your attention to the fact that failing full payment even after
reminders have been issued, you will not be given the keys to accommodation
if you present yourself at your holiday destination. The accommodation for your
stay will be ready for you at 5 PM, you may present yourself at reception prior
to this time to carry out registration formalities. Keys are to be returned before
10 AM on the day of departure. For short stays, keys are available from 11 AM
subject to payment of the said sum and must be returned before 5 PM on the
day of departure, apart from the following “Partner” Residences: «Anglet Mer
& Golf» and «Arcachon Le Trianon» (arrival from 5 PM and departure before10
AM), as well as Residences «Biarritz Eugénie», «Bidart Llbarritz», «Urrugne
Fort Socoa», «Ciboure Soko Eder», «Hendaye Sokoburu» and «Argelès-sur-Mer
Port Argelès» (arrival from 3 PM and departure before 12 noon ), (arrival from
2 PM and departure before 12 noon). If you cannot arrive at the specified time
due to a major difficulty, it is essential that you inform the residence so that in
certain cases you can obtain the access codes. In such cases, arrangements will
be made directly with you so that you can obtain the keys to your accommodation
as soon as you arrive.
For the «Latitude Hotels», the Hotel de l’Esterel and Pont Royal Hotel in
Provence and «Adagio»:
Keys are issued from 2 PM on the day of your arrival provided the said payment
has been made. These keys must be returned before 10 AM on the day of
departure. After this time you will be charged for an extra night.
For «Adagio Access»: Keys are issued from 11 AM on the day of your arrival
provided the said payment has been made. These keys must be returned before 2
PM on the day of departure. After this time you will be charged for an extra night.
ARTICLE 7 - DEPOSIT
On arrival, you will be asked for a deposit of guarantee of 200 Euros (500
Euros for the «PIERRE ET VACANCES PREMIUM» label) per apartment, room,
villa or house. This will be returned to you at the end of your holiday after you
have paid for any additional services used on site (telephone, car park, etc.)
With deductions made for any damages, unpaid services and loss of keys for
apartments, rooms, villas, or houses issued on arrival. No deposit will be
requested for Adagio City Aparthotels and Latitudes Hotels.
ARTICLE 8 - MINORS
We would like to draw attention to the fact our Residences do not come under
the control of a holiday and leisure club, in the sense of the decree n°2002-883
dated, May 3rd 2002, and are not adapted to operate collective or individual
holidays outside of the family domicile for minors under the age of 18 who are
not accompanied by their legal guardians. PVCP reserves the right to refuse
access to an apartment, room or villa that has been reserved in ignorance of
this provision, for minors aged under 18 years, who are not accompanied by their
legal guardians and who report to the reception of a Residence, and for PVCP
to proceed immediately to cancel the holiday. Under the same conditions, PVCP
may, at any time before the start of the stay, proceed to cancel the booking, if it
is discovered that the cottage or room is to accommodate minors aged under 18
years who are not accompanied by their legal guardian.
ARTICLE 9 - PETS
Domestic animals are accepted, on presentation of a rabies vaccination
certificate and a handling license for dogs which come under the list of
categorised dogs in the majority of our Residences, through the payment of the
following rates on site:
- For «PIERRE & VACANCES», «PIERRE & VACANCES HOLIDAY VILLAGES” and»
PIERRE & VACANCES PREMIUM»:
For Holiday Apartment complexes and the Hotel de l’Esterel and Hotel du Pont
Royal, the following rates are payable on site:
For holidays of 7 nights or more, €55 per pet per week
For holidays of less than 7 nights, €9 per pet per night
For stays in hotels, €11 per pet per night
Animals are not accepted in the Torremirona Residence in Spain.
- For «MAEVA»:
For holidays of 7 nights or more, €54 per pet per week
For holidays of less than 7 nights, €8 per pet per night
Animals are not accepted in some of the Residences (the Residences concerned
are listed in this catalogue, please refer to the summary table)
They are permitted, on a lead, in the communal sections, but are forbidden
around swimming pools. We regret to inform you that animals are not admitted
to our hotels, except in exceptional circumstances (please ask us).
- For «ADAGIO»: please contact the Residence directly to find out
ARTICLE 10 – ESTABLISHMENT REGULATIONS
In order to facilitate the smooth running of your holiday, establishment
regulations are posted in each apartment, room and house; please acquaint
yourself with them and adhere to them. We invite you to take certain precautions
in order to prevent any eventual inconvenience: close your picture windows
before leaving your apartment, room or house and lock the door. We remind you
that the PVCP cannot be held liable for the loss of personal belongings left in
your apartment, room or house when you vacate them.
ARTICLE 11 - EARLY DEPARTURE / EARLY END TO SPORTS OR LEISURE
ACTIVITIES
Early departure or early end to sports or leisure activities booked with PVCP
does not give any entitlement to reimbursement from them. However, depending
on the package available with the Europ Assistance policy (see article 18),
depending on the cause of departure from the site or termination of the activity
being duly proven and falling within the terms of the policy, you may benefit from
reimbursement on a pro rata basis, from the date of your departure from the site
or the day of termination of the activity. With respect to early departure, you may
benefit from pro rata reimbursement of the holiday only if you have fully vacated
your apartment or room.
ARTICLE 12 - CHANGES MADE TO OUR PROGRAMMES
If circumstances compel us, and only in circumstances of force majeure, outside
our control, we may be obliged to change all or some of our programmes (total
or partial closure of a site or a communal facility such as a swimming pool,
restaurant, etc.).You will be informed of any such circumstances as soon as
possible.
ARTICLE 13 - AFTER SALES HELP
Our on-site teams are at your disposal during your holiday to respond to your
complaints, resolve any problems and enable you to enjoy your holiday to the
full. Simply contact them with any requests. After your holiday, any claim
should be made:
- by registered letter with acknowledgement of receipt, sent to Groupe Pierre &
Vacances Center Parcs - Service Relations Clientèle APS - 11, rue de Cambrai -
75947 Paris Cedex 19 France, or
- by e-mail to: relation.client@fr.groupepvcp.com
within two months of the end of your holiday so that we can deal with it as
quickly as possible. We draw your attention to the fact that the longer you take
to inform us of your claim, the more difficult it becomes to deal with it in your
best interests. In your letter, please specify the name of the person who booked
the holiday, the booking number, the place and dates of your holiday and the type
of apartment or room booked in order to facilitate the processing of your claim.
Please also enclose all documentary evidence to enable us to process your claim
as quickly as possible.
ARTICLE 14 - CATALOGUE
The present terms and conditions of sale come into effect on January 1st
2012. They cancel and replace all other terms and conditions of sale that were
circulated previously. Booking one of our holidays implies acceptance of our
particular terms and conditions of sale. General descriptions and photos of
apartments are provided for informational purposes only. Given the diversity
of the PVCP range, there are differences in the layout and decoration of certain
apartments and rooms. We present general descriptions of our apartments,
sample layout plans, photographs and virtual visits in our catalogue and on our
website: these are supplied for informational purposes only. For further details,
please do not hesitate to ask your travel agent. We would also remind you that
any request for a specific apartment location or orientation is an additional
service and does not constitute a contractual guarantee. Specific details for
PIERRE & VACANCES HOLIDAY VILLAGES: you may choose the location of your
apartment, depending on availability: 30 Euros per apartment for a short stay, 50
Euros for a 1-week stay; 80 Euros for a 2-week or more stay. This request must
be directly addressed to the holiday village up to 15 days before the beginning
of your stay; For the residences PIERRE & VACANCES, PIERRE & VACANCES
PREMIUM and MAEVA: you may choose the location of your apartment,
depending on availability Rates and terms available directly from the Residence.
If you do not make a specific request, your apartment will be allocated to you
at random. All information on sporting and leisure activities at the resorts and
surrounding area is supplied to us by tourist offices and is passed on to you by
way of indication. We cannot be held liable if any of these facilities are no longer
available at the time of your holiday. For further information on the facilities
of the resorts, please contact their respective tourist offices directly. As our
catalogue is printed well in advance, please ask your travel agent about opening
dates, sports facilities (type and quantity), activities and services offered by
the site which determine your choice of site. Furthermore, we cannot be held
responsible for works undertaken by individuals or local authorities which might
inconvenience our customers in the resorts or towns.
ARTICLE 15 – RESPONSIBILITY - LIABILITY
- We draw to your attention to the fact that renting a holiday apartment does not
fall within the framework of hoteliers’ liability. Consequently, PVCP and all other
companies for which PVCP provides distribution, may not be held liable in the
event of loss, theft or damage to personal items in its Residences, whether in the
apartments, the car parks or communal areas (ski areas etc.)
- Please note that the liability of hotel operators for the rental of accommodation
in the hotels is governed by the French Civil Code. The hotel operator can
therefore be held liable only within the legal limits in the event of loss, theft or
damage to personal belongings in their rooms, car parks or communal facilities
(ski sheds, cycle garages, etc).
- The statute of limitations for the sums due to PCVP does not fall within the
field of application of hotel statutes of limitations (article 2272 of the Civil Code).
In exception to Article 2244 of the Civil Code, the sending of a registered letter
by PVCP to any client-debtor interrupts the statute applicable in such a case.
ARTICLE 16 – INSURANCE
We have taken out a policy with Europ Assistance, no. 53 789 536 M this policy
comprises a number of options. This insurance takes effect from the day of
your reservation or the following day at midday after payment of the premium
if subscription takes place after reservation. It must be taken out before the
beginning of cancellation costs.
Important: Under the terms of this contract, legal or tax residents of the
European Union, Andorra, Gibraltar, Liechtenstein, Monaco, Norway, San
Marino, and Switzerland are insured.
The «Pack Soleil» package groups together the guarantees of «Multirisque»
package and the «Garantie Soleil» coverage. The “Garantie Soleil” must be
taken out seven days before the beginning of your holiday and covers your
holiday for a minimum of seven days * for unfavourable sun conditions. If,
during your holiday, you do not have at least three sunny days per section of
seven full days* (for example three days for holidays from seven to 13 days,
six days for holidays from 14 to 20 days), you will be reimbursed a fixed sum of
150€ inclusive of VAT by the par «Pack Soleil» taken out. A day is considered as
sunny when between 10 AM and 6 PM the reference weather stations of Météo
France (defined and transmitted by Metnext, co-company of Météo France and
NYSE Euronext) have registered solar output greater than 120 W/m2 for at least
two hours. The sun pack can be taken out for all holidays that fall between
01/04/2012 and 20/10/2012. The terms and conditions for the application
of the guarantees issued by Europ Assistance, are available on our website

ARTICLE 1 - REGISTRATION / BOOKING / PAYMENT


1.1- Registration and booking terms and conditions
Every registration must be accompanied by a payment including:
The administration charge:
- For bookings via the internet: €25 per booking for any stay of 7 nights or more, €15 per booking for any stay of 6 nights or less);
- For other bookings: €30 per booking for any stay of 7 nights or more, €20 per booking for any stay of 6 nights or less); N.B.: there are no administrative fees for bookings made in Adagio City Aparthotels.
A deposit corresponding to:
- 25% of the overall price of accommodation and any additional services (whether included or not), in particular: meals, children’s clubs, sporting activities, etc.
- 100% of the overall price of any transport services (flights, transfer, car hire, rail travel),
- 100% of the value of insurance premiums if applicable.
1.2- Right to withdraw
- From the date of payment of fees and advances up to the 31st day (for a stay in a tourist residence) or the 15th day (for a stay in a hotel or hotel apartment) inclusive preceding your stay, you have the right to withdraw. If you exercise this right, the deposit paid will be refunded to you but the abovementioned administration charge will be retained by P&VCP. The total amount of insurance is payable upon reservation and cannot be reimbursed.
- Your attention is drawn to the fact that business relating to the organisation and sale of travel and holidays for a specific date and/or period is not subject to the seven-day «coolingoff » period which applies to other forms of remote sales.
1.3- Payment of the balance
The full price of booking plus any additional services is payable:
- 30 days before the start of your holiday in a tourist residence;
- 14 days before the start of your holiday in a hotel or hotel apartment;
- Or in all cases immediately for any last minute reservations. The full price must have been paid before your travel documents (including your rental contract or accommodation slip, description of the location, plane ticketsetc.) are sent by P&VCP.
If the account is not settled within the specified timeframe and you have not exercised your right to withdraw, P&VCP reserves the possibility to consider the sale as confirmed from either the 30th day or the 14th day before your stay depending on your reservation and may apply the cancellation conditions drawn up for this event and defined hereafter as a consequence. Your commitment therefore become final on payment of the balance before the 30th or 14th day of your stay or, in the event of non-payment of the balance and no use of the right to withdraw on your behalf, from the 30th or 14th day preceding your stay. P&V’s commitment becomes final before the 30th or 14th day preceding your stay, from the sending of your reservation confirmation.
1.4 - Methods of payment
For all bookings up to 31 days before your holiday, payment of 100% of the cost of the holiday by any method of payment:
credit card (*), cheque (**), or bank transfer (***)
For all bookings between 30 and 15 days prior to the holiday, you may:
- Pay 100% of the cost of your holiday by credit card (*)
- Or pay 25% of the cost of the holiday as a deposit by credit card (*) and the balance within 5 days by cheque (**) or bank transfer (***).
For all bookings between 14€ and 8 days prior to your holiday, you may:
- Pay 100% of the cost of your holiday by credit card (*)
- Or pay 50% of the cost of the holiday as a deposit by credit
card (*) and the balance within 5 days by cheque (**) or bank transfer (***).
For all bookings made less than 7 days prior to the beginning of the holiday, you must pay 100% of the cost of your holiday by credit card only (*).

N.B.: Persons not residing in France may pay only by credit card, Eurocheques, bank cheque in Euros or bank transfer accompanied by the booking voucher. Your travel documentation
Sent 30 (or 14) days before the start of your holiday on condition of the settlement of the balance of your holiday, you will receive travel documentation containing: all the practical information required to help you getorganised (itinerary, map, address) and the rental contract for your accommodation and the services booked.

(**) Cheques and vouchers accepted: bank cheques, holiday vouchers, gift vouchers (subject to the terms and conditions to be validated by the salesperson)

ARTICLE 2 - PRICES


2.1 - Accommodation
Our prices include all taxes and include the provision of the accommodation, including charges (water, electricity, heating) but excluding tourist tax, payable on site, pet supplements, optional insurance premiums andadministration charges, payable on booking where applicable. Note that accommodation is provided for a specific number of occupants on booking may not be occupied by a larger number of people.
Note that young children are considered as occupants in their own right. Not all of our balconies, loggias, terraces and gardens are equipped with tables and chairs.
2.2 - Optional services
Our accommodation rates do not include optional extra services on offer in the catalogue, on our website or on site. You may be offered special rates depending on the terms and conditions and availabilities at the time of booking and the economic situation at that time. Changes to the economic situation compared to that at the time of publication may include the following:
- changes in the fares themselves (due to fuel prices, extra costs invoiced, etc.);
- the additional extras that P&VCP may invoice; in the case of additional commitments during the season due to stock initially offered before your registration running out.
2.3 – Snow Guarantee (Mountain sites)
2.3.1 – Eligibility conditions
Our accommodation rates include a snow guarantee, valid only during winter 2010/11, you can choose to cancel your holiday booking if the following conditions concur:
1) The initial booking must have been made directly with P&VCP: on the website www.pv-holidays.com, in a PIERRE & VACANCES CENTER PARCS shop, directly at a P&VCP residence, or at the central booking, and not including those not booked directly with P&VCP, particularly with Tour Operators;
2) The booking must concern a holiday taking place on a site with one of the following brands: «PIERRE & VACANCES PREMIUM» or «PIERRE & VACANCES RESORT» or «PIERRE & VACANCES MONTAGNE» or «MAEVA» in the mountains,
2.3.2 – What the guarantee includes
Subject to compliance with the conditions set out in point 2.3.1 above, you can send a request for the cancellation of a holiday in the event of lack or excess of snow, when the following three conditions concur:
1) The lack or excess of snow occurs in a ski area located above 1200 metres altitude; and
2) The departure is between the 3rd Saturday in December and the 2nd Saturday in April; and
3) The lack or excess of snow entails the closure of over 2/3 of the ski lifts normally in service on your holiday site, for at least 2 consecutive days, within the 5 days preceding your departure.
2.3.3 – How to make the claim
You must inform P&VCP of your cancellation, then contact EUROP ASSISTANCE within five working days of the event covered by the guarantee. To do so, you must send EUROP ASSISTANCE a cancellation declaration (including the insurance policy number: 63.112.088.V) by post to EUROP ASSISTANCE - Sinistres Assurance Voyages - 1 promenade de la Bonnette – 92633 GENNEVILLIERS Cedex, fax: 00 33 01.41.85.85.61 or email: slv@europ-assistance.fr. EUROP ASSISTANCE will send you a form to be completed and with documentary proof of the lack or excess of snow and the original cancellation invoice drawn up by P&VCP.
2.3.4 - Amount of refunds
You will be refunded the deposit paid or any other sum retained by P&VCP, excluding the administration fees if such were initially paid. The refund is paid minus the specific deductibles shown in the following Guarantee Amount Table. The guarantee is granted provided that the rental accommodation is fully vacated. All of the tourist services covered by the «Snow Guarantee» insurance, whether additional or successive, constitute a single holiday which only one date of departure is taken into account: the date given by P&VCP for the beginning of the services insured.

2.4 – Reduction
The reductions mentioned in the brochure are only applicable on the accommodation section; any other services are excluded (restaurants, sport and leisure, etc).

ARTICLE 3 - TOURIST TAX


Tourist tax, collected on behalf of the local authorities, is not included in our prices. It is approximately €1 per person per day and must be paid on site.

ARTICLE 4 - CHANGE / CANCELLATION OF HOLIDAY BY THE CUSTOMER


4.1 - Changes
4.1.1 – Accommodation
a) For hotels
For any hotel stay of three nights or less, we will endeavour to accept your requests to change the date, type of accommodation or holiday venue as far as possible, subject to availability. These changes may be made at noadditional cost. Any request to reduce the length of your holiday will be deemed by P&VCP to be a partial cancellation and will be subject to the cancellation terms referred to in 4.2 hereafter.
For any hotel stay of three nights or less, we will also endeavour to accept your requests to change the date, type of accommodation or holiday venue as far as possible, subject to availability. If the value of your booking(excluding optional services) after the change is lower than the value of the booking before the change, we will retain €10 as a charge for this change. Any request to reduce the holiday length will be deemed by P&VCP to be a partial cancellation and will be subject to the cancellation terms referred to in 4.2 hereafter.
b) For tourist residences
Change of type
We will endeavour to accept requests to change the type of apartment as far as possible, subject to availability. If the value of the booking (excluding optional services) after the change is lower than the value of the booking before the change, we will retain €10 as a charge for this change.
Change of holiday date or place
We will endeavour to accept requests to change the date or holiday venue as far as possible, subject to availability. However, please note that this type of change causes variable costs for P&VCP depending on the date on which you make your request.
The refore for all changes of holiday date or place, we will apply the following charges:
- if your request for change is sent at least 30 days before your arrival and if the amount of the modified booking is less than the amount of the initial booking: €10
- if your request to change is made between 30 and 15 days prior to your arrival: 15% *
- if your request to change is made between 14 and 8 days prior to your arrival: 30% *
- if your request to change is made between 7 and 4 days prior to your arrival: 50% *
* of the total cost of the accommodation.
No request to change will be taken into account if it is received by P&VCP three days or less prior to your arrival.
N.B.:
- Any request to extend the length of your holiday will be accepted by P&VCP without any additional charge
- Any request to reduce the length of your holiday will be deemed by P&VCP to be a partial cancellation and will be subject to the cancellation terms referred to in 4.2 hereafter.
4.1.2 – Optional services
We will endeavour to accept requests to change the optional services as far as possible, subject to availability. If the value of the optional service after the change is lower than the value of the optional service before the change, we will retain €10 as a charge for this change.
4.2 – Cancellation (total or partial)
In the event of cancellation, please notify us either by post to the following address PIERRE ET VACANCES CENTER PARCS service annulations BP291 75921 PARIS CEDEX 19, or by fax 33 ( 01) 58 21 50 97 for the attention of «Service Annulations», or by e-mail to the following address: annulation.adv@pierrevacances. fr. The date of cancellation is determined by the date of receipt of notification.
4.2.1 - Accommodation
a) Holiday in a Residence
Whatever the date the booking is cancelled, we will retain the administration charges, if applicable, initially paid and any insurance premiums taken out.From the 30th day prior to the holiday, we will retain the following indemnities depending on your holiday package:
- If the request to change is made between 30 and 15 days prior to your arrival: 25% *
- If the request to change is made between 14 and 8 days prior to your arrival: 50% *
- If the cancellation request is made seven days or less before your arrival: 100% *
* of the total cost of the accommodation.
b) Holiday in a hotel or apart-hotel
Whatever the date of cancelling the booking, we will retain the amount of any insurance premiums taken out. Furthermore, for any stay greater than three nights, if you inform us after the 14th day preceding your arrival and before 6PM the day before your arrival, we will retain the following compensation depending on the terms of your holiday:
4 to 6 nights, payment for one night*,
7 nights or more, payment for two nights*,
*the cost of the “night” corresponds to the total price of the holiday booked divided by its number of nights.
Half-board or full board holiday:
The charges will be the same as above.
4.2.2 – Optional services
For any additional services invoiced (activities, meals, etc.) cancelled after the 30th day (for a holiday in a residence) or 14th day (for a holiday in a hotel or hotel apartment) preceding your holiday, we will retain €10 per cancelled service for cancellation costs.
Special case (1): for any cancellation of an ESF ski lesson between four days before your arrival and the date of arrival, we will retain 100% of the cost of the service.
Special case (2): the entrance ticket for Parc Disneyland® and Parc Walt Disney Studios® is non-refundable.
4.3 - No-show at holiday venue
If you do not turn up at your holiday venue, we will retain the administration charge initially paid and the premiums for any insurance policies taken out plus the following:
4.3.1 - Accommodation
a) Holiday in a Residence
100% of the total value of the holiday.
b) Holiday in a Hotel
Accommodation only:
1 to 3 nights: payment for one night*,
4 to 6 nights: payment for two nights*,
7 nights or more = payment for two nights*,
*the cost of the “night” corresponds to the total price of the holiday booked divided by its number of nights.
Half-board or full board holiday:
The charges will be the same as above.
4.3.2 – Optional services
No refund is payable for any unused and invoiced services at the holiday venue. We advise you to take out one of the insurance deals with Europ Assistance (see Article 15 - Insurance). The premium must be paid in full at the time of booking and is not refundable in any circumstances.

ARTICLE 5 - ARRIVAL AND DEPARTURE


The P&VCP group reminds you that in the event of full payment not being received (despite reminders being sent) that the accommodation keys will not be made available to you. If you cannot arrive at the specified time due to a major difficulty, it is essential that you inform the residence so that you can obtain the access codes. They will then make arrangements directly with you so that you can obtain the keys when you arrive.
- For sites labelled «PIERRE & VACANCES» and «PIERRE & VACANCES RESORTS»:
Keys are issued from 5PM on the day of the arrival provided the said payment has been made. These keys must be handed in by 10AM on the day of the departure (Saturday in most cases). For short stays, keys are available from 2pm and must be returned by 12 noon on the day of departure.
- For sites labelled «PIERRE & VACANCES PREMIUM»:
For any stay of a week (seven nights) or more, key handover takes place from 5PM on the day of arrival (Saturday in most cases) subject to payment of the said sum. Keys are to be returned before 10AM on the day of departure. After this time you will be charged for an extra night.
For short stays, keys are available from 3PM subject to payment of the said sum and must be returned by 12 noon on the day of departure. After this time, you will be charged for an extra night.
- For sites labelled «MAEVA»:
The accommodation for your stay will be ready for you at 5pm: you may present yourself at reception prior to this time to carry out registration formalities. Keys are to be returned by 10am on the day of departure. For short stays, keys are handed over from 11am subject to the aforementioned payment, and must be returned by 6pm on the date of departure, except for the following «Partner» residences: «Anglet Mer & Golf» and «Arcachon Le Trianon» (arrival from 5pm and departure by 10am), as well as the residences «Biarritz Eugénie», «Bidart Llbarritz», «Urrugne Fort Socoa»,«Ciboure Soko Eder», «Hendaye Sokoburu» and «Argelèssur-Mer Port Argelès» (arrival from 3pm and departure by 12 noon).

ARTICLE 6 - DEPOSIT


You will be asked for a deposit of €200 (€500 for Pierre & Vacances premium) per apartment, room, villa or house on arrival. This will be returned at the end of your holiday after you have paid for any additional services used on site (telephone, car park, etc.) With deductions made for any damages, unpaid services and loss of keys for apartments, rooms, villas, or houses issued on arrival. You will not be asked for a deposit for Adagio City Aparthotels.

ARTICLE 7 - PETS


Pets are allowed in most of our residences, on presentation of a rabies vaccination certificate, subject to payment on site of the following charges:
Particular conditions for the label «PIERRE & VACANCES PREMIUM»:
For stays in hotels, €11 per pet per night For Tourist Residences, the following fixed sum amounts are due on site:
for holidays of 7 nights or more, €49 per pet per holiday
For holidays of less than 7 nights, €9 per pet per night
Particular conditions for the labels «PIERRE & VACANCES» and «PIERRE & VACANCES RESORTS»:
For holidays of 7 nights or more, €49 per pet per holiday
For holidays of less than 7 nights, €8 per pet per night
For stays in hotels, €11 per pet per night Pets are not allowed in residences in Spain or Italy.
Particular conditions for the label «MAEVA»:
Fixed fee of €48 (depending on the Residences) per pet, per week or holiday, to be paid on booking or on site on your arrival (the residences concerned are listed in this catalogue). They are permitted, on a lead, in the communal sections, but are forbidden around swimming pools. We regret to inform you that animals are not accepted in our hotels, except in exceptional circumstances (please ask us)

ARTICLE 8 – ESTABLISHMENT REGULATIONS


In order to facilitate the smooth running of your holiday, establishment regulations are posted in each apartment, room and house; please acquaint yourself with them and adhere to them. Certain precautions can prevent possible problems:
close your picture windows before leaving your apartment, room or house and lock the door. We remind you that P&VCP cannot be held liable for the loss of personal belongings left in your apartment, room or house when you vacate them.

ARTICLE 9 - FORMALITIES FOR TRAVEL AND HOLIDAYS ABROAD


For these holidays including travel, each passenger must have a currently valid identity card or passport. We advise you to check the validity of the identity cards or passports of all members of the party (adults/children/infants), your insurance, and for holidays abroad, currency exchange regulations and any necessary vaccinations. We will not be held responsible for anyone not complying with the rules detailed in the brochure or the travel documents.
- Minors travelling alone: in order to travel abroad, in addition to their valid identity card or passport, minors must have an official authorisation to leave the country signed by their parents or guardians.
- Foreign nationals or holders of travel documents: you must enquire with the consulates of each country about any necessary visas. The occupancy of accommodation will depend on flight times serving airports close to our Residences.

ARTICLE 10 - EARLY DEPARTURE / EARLY END TO SPORTS OR LEISURE ACTIVITIES


Early departure or early end to sports or leisure activities booked with P&VCP does not give any entitlement to reimbursement from the latter. However, depending on the package available with the Europ Assistance policy (see article 15), depending on the reason for the departure from the site or termination of the activity being duly proven and falling within the terms of the policy, you may benefit from reimbursement on a pro rata basis, from the date of your departure from the site or the day of termination of the activity. With respect to early departure, you may benefit from pro rata reimbursement of the holiday only if you have fully vacated your apartment or room.

ARTICLE 11 - CHANGES TO OUR PROGRAMMES


If circumstances compel us, and only in circumstances of force majeure, outside our control, we may be obliged to change all or some of our programmes (total or partial closure of a site or a communal facility such as a swimming pool, restaurant, etc.).

ARTICLE 12 - AFTER SALES SERVICE


Our on-site teams are at your disposal during your holiday to respond to your complaints, resolve any problems and enable you to enjoy your holiday to the full. Simply contact them with any requests you have. After your holiday, any claim should be made:
- by registered letter with acknowledgement of receipt, sent to Groupe Pierre & Vacances Center Parcs - Service Relations Clientèle - 11, rue de Cambrai - 75947 Paris Cedex 19 France, or
- by e-mail to: relations.client@pierre-vacances.fr within two months of the end of your holiday so that we can deal with it as quickly as possible. We draw your attention to the fact that the longer you take to inform us of your claim, the more difficult it becomes to deal with it in your best interests. In your letter, please specify the name of the person who booked the holiday, the booking number, the place and dates of your holiday and the type of apartment or room booked in order to facilitate the processing of your claim. Please also enclose all documentary evidence to enable us to process your claim as quickly as possible: certificate issued by the site and/or personal documents (certificate of non-use of services, certificate of premature departure, hospitalisation report, etc.).

ARTICLE 13 - CATALOGUE


Booking one of our holidays implies acceptance of our particular terms and conditions of sale. General descriptions and photos of apartments are provided for informational purposes only. Given the diversity of the P&VCP range, there are differences in the layout and decoration of certain apartments and rooms. We present general descriptions of our apartments, sample layout plans, photographs and virtual visits in our catalogue and on our website: these are supplied for informational purposes only. For further details, please do not hesitate to ask your travel agent. We would also remind you that any request for a specific apartment location or orientation is an additional service and does not constitute a contractual guarantee. All information on sporting and leisure activities at the resorts and surrounding area is supplied to us by tourist offices and is passed on to you by way of indication. We cannot be held liable if any of these facilities are no longer available at the time of your holiday. For further information on the facilities of the resorts, please contact their respective tourist offices directly. As our catalogue is printed well in advance, please ask your travel agent about opening dates, sports facilities (type and quantity), activities and services offered by the site which determine your choice of site. Furthermore, we cannot be held responsible for works undertaken by individuals or local authorities which might inconvenience our customers in the resorts or towns.

ARTICLE 14 – RESPONSIBILITY - LIABILITY


- We would draw to your attention the fact that renting a holiday apartment does not fall within the framework of the hoteliers’ liability. Consequently, P&VCP cannot be held liable in the event of the loss or theft of or damage to personal effects in our Residences, apartments, car parks or communal areas (bicycle shed, etc.).
- Please note that the liability of hotel operators for the rental of accommodation in the hotels is governed by the French Civil Code. The hotel operator can therefore be held liable only within the legal limits in the event of loss, theft or damage to personal belongings in their rooms, car parks or communal facilities (ski sheds, cycle garages, etc).
- Provision for amounts due to P&VCP is not included in the field of application of the hotel statute (article 2272 of the Civil Code). In exception to Article 2244 of the Civil Code, the sending of a registered letter by P&VCP to any client-debtor interrupts the statute applicable in such a case.

ARTICLE 15 – INSURANCE


We have taken out a policy with Europ Assistance, no. 53 789 536 789 536 M: this policy comprises a number of options. This insurance takes effect from the day of your reservation or the following day at midday after payment of the premium if subscription takes place after reservation. It must be taken out before the beginning of cancellation costs.
N.B.: Under the terms of this contract, legal or tax residents of the European Union, Andorra, Gibraltar, Liechtenstein, Monaco, Norway, San Marino, and Switzerland are insured.
